FATNAP.APP PRIVACY POLICY

This Privacy Policy describes how FatNap, Inc. ("FatNap," "we," "us," or "our") collects, uses, and discloses information about you through our website (the "Website") and the FatNap.app mobile application (the "App"), collectively referred to as the "Service."
By accessing or using the Service, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with the practices described in this Privacy Policy, please do not use the Service.
1. Information We Collect
We collect various types of information in connection with the Service, including:
- Information You Provide Directly:
- Account Information: When you create an account, we collect your name, email address, password, and any other information you choose to provide (e.g., age, gender, general health goals).
- Affiliate/Investor Information: If you participate as an affiliate or investor, we may collect additional information such as payment details and other data necessary to administer our affiliate program. By participating, you consent to the use of your email address as your affiliate ID, which may be shared publicly to promote your affiliate status. For your privacy, we recommend creating a separate email address specifically for this purpose.
- Communications: When you communicate with us (e.g., customer support inquiries, feedback), we collect the content of your communications and our responses.
- Information Collected Automatically:
- Audio Data: The App accesses your device's microphone to analyze your breathing patterns and provide feedback for breathing exercises. This audio data is processed locally on your device in real-time. We do not store raw audio recordings on our servers. Certain aggregated and anonymized data derived from this analysis (e.g., breathing rate, duration of exercises) may be transmitted to our servers to track your progress and improve the Service.
- Usage Information: We collect information about how you access and use the Service, such as the features you use, the time and duration of your activities, and your interactions with the Service.
- Device Information: We collect information about the device you use to access the Service, including IP address, device type, operating system, unique device identifiers, and mobile network information.
- Log Data: Our servers automatically record information that your browser or app sends whenever you visit the Service ("Log Data"). This may include your IP address, browser type, referring/exit pages, and timestamps.
2. How We Use Your Information
We use the information we collect for various purposes, including to:
- Provide, maintain, and improve the Service, including personalizing your experience.
- Process your account registration and manage your account.
- Understand and analyze how you use the Service to improve its functionality and features.
- Communicate with you, respond to your inquiries, and provide customer support.
- Send you technical notices, updates, security alerts, and administrative messages.
- Monitor and analyze trends, usage, and activities in connection with the Service.

- Administer incentive programs (e.g., beta testing, affiliate program) as described in our Terms of Service.
3. How We Share Your Information
We may share your information in the following circumstances:
- With Service Providers: We may share your information with third-party vendors, consultants, and other service providers who perform services on our behalf, such as hosting, data analytics, and customer support. These service providers are authorized to use your information only as necessary to provide these services to us.
- For Legal Reasons: We may disclose your information if we believe it's necessary to comply with a legal obligation, such as a subpoena or court order, or to protect the rights, property, or safety of FatNap, our users, or the public.
- Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity.
- Aggregated or Anonymized Data: We may share aggregated or anonymized information that cannot reasonably be used to identify you. For example, we may share trends about general user breathing patterns for research or marketing purposes.
- With Your Consent: We may share your information for any other purpose with your explicit consent.
4. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect the information we collect from unauthorized access, use, or disclosure. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your account password.
5. Data Retention
We retain information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need your information, we will delete or anonymize it.
6. Your Choices and Rights
- Account Information: You may update or correct your account information by logging into your account settings. If you wish to deactivate your account, please contact us.
- Audio Data: You can manage microphone access permissions for the App through your device's operating system settings. Note that disabling microphone access will prevent the core functionality of the FatNap.app Service.
- Communications: You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails. Please note that we may still send you non-promotional messages, such as those about your account or our ongoing business relations.
- Do Not Track: Some web browsers offer a "Do Not Track" (DNT) signal. We do not currently respond to DNT signals.
7. Children's Privacy
The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently received personal information from a child under 13, we will delete such information from our records.
8. International Data Transfers
Your information may be stored and processed in any country where we have facilities or where we engage service providers. By using the Service, you understand that your information may be transferred to countries outside of your country of residence, which may have different data protection laws than those in your country.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will post any changes on this page and update the "Effective Date" at the top of this Privacy Policy. We encourage you to review this Privacy Policy periodically to stay informed about our information practices.
